Appeal and Appeals Council

Decisions made by the councils of authorization of general education, professional and higher educational institutions, as well as accreditation of educational programs, may appeal to the Appeals Council or the Court, by the authorization applicant/accreditation applicant, according to the law, within one month from the date of introduction.

The members of the Appeal Council are appointed and dismissed by the Prime Minister of Georgia on the recommendation of the Ministry.

 

The appeal must be made in writing and must state:

a) Appeal to the Appeals Council;

b) Name, address and contact information of the person submitting the appeal;

c) Name of the council whose decision is appealed;

d) Name of the appealed decision;

e) Demand;

f) Circumstances on which the request is based;

g) List of documents attached to the appeal, if any documents are attached to the appeal.

 

The Appeals Council will not consider an appeal if:

a) The appealed decision is pending before the court;

b) The appeal is filed by an unauthorized person;

c) The deadline for submitting an appeal has passed;

d) Consideration of the requested issue is beyond the scope of the authority of the Appeals Council.

 

In the case of authorization, the Appeals Council is obliged to consider the appeal and take the appropriate decision within 60 calendar days after receiving the appeal, and in the case of accreditation - within 90 calendar days.

The Appeals Council shall make one of the following decisions:

a) On sharing the decision of authorization/accreditation councils;

b) To return the matter to authorization/accreditation councils for reconsideration.

 

In the event of a decision by the Appeals Council to share the decision of the authorization/accreditation councils, the interested party has the right to appeal the said decision to the court in the manner and within the time limit established by the legislation.

In the event of a decision by the Appeals Council to return the matter to the authorization/accreditation boards for reconsideration, the relevant authorization council or accreditation council shall consider the issue in the manner established by these authorization/accreditation provisions and make a decision within the time limit set by the legislation.

The authorization seeker/accreditation seeking institution may appeal the decision related to authorization/accreditation only once.

 

In accordance with Article 241, Paragraph 2 of the Law of Georgia "On the Development of the Quality of Education", the following were appointed as members of the Appeals Council:

Goderdzi Buchashvili - Vice-rector of LTD “National University of Georgia” in administrative direction, Professor - Chairman of the Council;

Levan Nikoleishvili - LEPL - Georgian National Defense Academy named after Davit Agmashenebeli – Professor, Deputy Chairman of the Council;

Ketevan Gilashvili - Preschool Education Expert of the Preschool and General Education Development Department of the Ministry of Education, Science and Youth of Georgia - Secretary of the Council;

Erekle Astakhishvili - Deputy Rector of LEPL - Ivane Javakhishvili Tbilisi State University;

Irma Shioshvili - Deputy Rector of LEPL - Iakob Gogebashvili Telavi State University, Professor;

Irakli Kordzaia - Dean of the Faculty of Tourism of LEPL - Batumi Shota Rustaveli State University, Associate Professor;

Ketevan Natriashvili - Head of the professional education program team, project manager of the German consulting company - PE Consult GmbH;

Anastasia Qitiashvili - Professor of LEPL - Ivane Javakhishvili Tbilisi State University, Director of Social Psychology Center;
